By commissioning me for custom artwork or buying from my shop, you are agreeing to the terms of service outlined below:
I. GENERAL DISCLAIMERS
⟡ By commissioning me or buying from my shop, you have read and fully agree to my terms of service.⟡ Prices are subject to change based on demand.⟡ I reserve the right to refuse or discontinue a commission at any time and for any reason.⟡ Disrespectful behavior will not be tolerated and your commission will be cancelled if it occurs.⟡ The terms outlined here may vary slightly depending on the type of commission.⟡ You may re-upload their artwork, but must credit me! (Ex: Reposting with my @’s: [Artfol, Inkblot, Pillowfort, Twitter, Tumblr, etc.] either on the initial post or in the comments section.)⟡ You will receive a sketch (or W.I.P.) of their art piece. This is considered the half-way point of the commission. It is encouraged that you ask for any edits at this point, as it will be easier to fix during this time.⟡ Any work started after the sketch is continued because of your approval. If you are not satisfied with the final piece and request any major editing (examples are as provided in the “Payment” section), there will be an upcharge in price or the current piece will be considered as the finished product and will not be changed.⟡ If there is no response or payment 3 days after being contacted by me, your slot will be forfeited.⟡ Any work done or made available to the client must not be used for generative AI (Artificial Intelligence, Machine Learning, AI/ML Training), cryptocurrency (NFT, blockchain) or any for-profit platforms or purposes. Such usage is completely prohibited and may result in legal action taken.
♦ Commercial rights are available to purchase if you wish to use a commission for profits (Merchandise/ads/print/ect.). Commercial rights exclude generative AI (Artificial Intelligence, Machine Learning, AI/ML Training), cryptocurrency (NFT, blockchain) usage.♦ Clients who are found breaking this rule after receiving a commission from me will be blacklisted from working with me in the future.♦ If sufficient evidence is discovered that a client is actively engaging in the use or spread of generative AI or cryptocurrency, I reserve the right to cancel any ongoing commissions with the client without providing any refund to the client for the cancelled works. I will retain full rights to any work cancelled by this clause. Furthermore, you will be blacklisted for commissioning me again.
II. PAYMENT & FEES
⟡ Initial payments are preferred to be paid in full upon commissioning (100% upfront). Half price initial payment is accepted (split 50% upfront and 50% after sketch approval); however, you will only receive a sketch of your commission. Full payment is required to continue the commission after the sketch. I will not accept anything less than half of your total payment.⟡ Payments are done in Canadian Dollar (CAD) and are through Artistree, Ko-Fi, or Vgen.⟡ A design fee will be charged for clients with no reference images that would like me to draw solely from a description and/or a collection of photos.⟡ Your commission will be accepted and put into a queue log after full/half payment and if you meet the criteria above. You can find my queue list here.⟡ Additional fees will be charged for excessive or major revisions (see “Revisions” below).⟡ The exact prices for the fees described above will be dependent upon the complexity of the commission.⟡ Tips are always appreciated but not necessary!
III. CLIENT OBLIGATIONS
⟡ Write in a clear and concise manner when filling out the commission form.⟡ Provide multiple clear reference images of the character/subject.⟡ Mood boards are welcome!⟡ Maintain professional conduct throughout the commission process.⟡ Respond in a timely fashion.⟡ Assume responsibility for any important information and clear descriptions/references you fail to provide me that results in my inability to complete your commission to your full satisfaction.⟡ Carefully read through the ToS and Commission Information.
IV. PROCESS & WORK SCHEDULE
⟡ I will send over a sketch for approval before continuing the commission. I will accept one complete revision at the sketch stage.⟡ I will show WIPs via Artistree, Ko-Fi, Vgen, and/or Email throughout the commission process.⟡ Sketch and subsequent in-progress shots will initially be sent as low-res, watermarked images.⟡ The time it takes to finish your commission varies 1 week - 3 months. I will always do my best to complete your commission within a timely manner, but please understand that sometimes life may get in the way and cause a delay in completing your commission (health, the complexity of the commissioned piece, other work, and con seasons). I will notify you as soon as possible of any issues that come up to keep you informed.
V. REVISIONS
⟡ One major revision and multiple minor revisions are allowed in the sketch phase and are covered in the commission price.⟡ A limited amount of minor revisions are allowed in coloring/painting stage and are covered in the commission price.⟡ Excessive minor revisions to the point that forward progress on the work has halted will incur additional fees.⟡ Revisions due to my own negligence are free.⟡ Additional major revisions or revisions on the final drawing (unless a misunderstanding from my side has been made) will incur additional fees.⟡ It is up to my discretion as to what constitutes minor and major revisions.
VI. COPYRIGHT & USAGE POLICY
I, Silhou (the artist):⟡ I retain the copyrights over any commissioned works.
Therefore, I am allowed to use the copyrighted artwork to:♦ Promote my commissions♦ Publish books with it (artbooks, etc.)♦ Display it anywhere to my liking (website, social media, etc.), unless the client has asked to keep the commission private.
⟡ I will NOT claim the intellectual property (IP) of the commissioned artwork. Any characters portrayed in the commissioned work remain copyrighted to their rightful owners.⟡ I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.⟡ I reserve the right to post the commissioned work on my social media, unless a NDA/privacy fee (+$50) is paid. A fee covers the loss of growth I could receive from posting artwork.⟡ I reserve the right to stream, record, and upload videos of the creation of the artwork, unless a NDA/privacy fee (+$50) is paid. A fee covers the loss of growth I could receive from posting artwork.You (the customer/client/commissioner):⟡ You retain the rights to the intellectual property (IP).⟡ The final product is strictly for your personal use only, unless you purchase commercial rights to make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, make prints, etc.).⟡ For commercial use, you must purchase the rights from me at 300% the original price.⟡ You MAY be allowed to sell the artwork if it is an Adoptable. But you may NOT sell for more than original price, flip the Adoptable, or profit off of an Adoptable design without a commercial license.⟡ You may NOT alter the commissioned artwork without my (the artist's) consent.⟡ You MAY upload the commissioned artwork (watermarked/glazed version) on any website and social channels. You must credit and link back to me/tag me when sharing or using the commissioned work.⟡ Credit is still required when using the work in any form commercially.
Usage:
⟡ You may use or edit the commissioned work in the following ways:
♦ Print the work for personal use.♦ Crop and/or resize the image for use as an avatar, header, video thumbnail, etc.♦ Use the artwork as reference for a study.♦ Post the artwork on social media, with credit to me clearly visible.
⟡ You may NOT use or edit the commissioned work in the following ways:
♦ Claim the artwork as yours.♦ Remove my watermark/signature.♦ Paint over or otherwise alter the artwork in ways not covered under the allowed uses above.♦ Use the commissioned piece in any technology related to NFTs, cryptocurrency, or generative AI.♦ Reproduce the work commercially without purchasing the rights from me.
VII. CANCELLATION AND REFUNDS
⟡ Once the final product is approved, a refund is not permitted.⟡ If you cancel your order before I start it, you can get a full refund.⟡ If for any reason I am unable to start your commission you will receive a full refund.⟡ You may cancel the commission any time, after which I will issue a refund equivalent to the amount of work not done.⟡ I reserve the right to cancel and refund the money for your commission at any time.⟡ If sufficient evidence is discovered that a client is actively engaging in the use or spread of generative AI or cryptocurrency, I reserve the right to cancel any ongoing commissions with the client without providing any refund to the client for the cancelled works. I will retain full rights to any work cancelled by this clause. Furthermore, you will be blacklisted for commissioning me again.⟡ You may not file a chargeback against me after you have given approval of the artwork. If you request chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply the payment processor with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.
VIII. WHAT YOU RECEIVE
⟡ Drafts/mockups that you must decide which one I should continue with (depending on the commission there might be fewer or more drafts).⟡ Sketches and/or W.I.Ps (Work in progress) that you must accept before I continue the work.⟡ Full-resolution file (300 DPI) of final drawing and a smaller version Glazed version for internet upload. Final file formats are usually PNG unless another resolution/file type is requested and can be provided.

What program / brushes do you use?
I use CSP (Clip Studio Paint) on my Desktop and Huion (Kamvas GT-191) and Procreate on my IPAD. I mostly use custom downloadable brushes, my most used one being "SOIPEN" (Content ID: 1778407) by SORASORA.
How do you come up with your original characters and their outfits?
My inspiration for characters often come from video games first, since they often are set in those worlds, and then I go researching related topics, cultures, and fashion within various sites and books. Browsing concept art from various media is one of my favorite things to do when looking for inspiration!
Can I draw fanart of your original characters?
Of course! I absolutely love fanart of my characters and am grateful for every piece I have receive! I just ask that you respect the following boundaries:

Characters do have their outfits, but you are allowed to branch out and dress them up in new attire. Artistic freedom is encouraged!

What TTRPGs do/have you play/played?
I currently have played in a handful of D&D 5e games, but have been planning to hopefully run/play some Call of Chuthlu, Kids on Brooms, Fabula Ultima, and PokeRole games in the future.
Do you plan on becoming a professional artist for videogames or other media?
It always has been a childhood dream of mine to be a professional artist for video games, I even went to school for 3D animation. It still is a dream, but on a more smaller scale. I'd much rather now be apart of a small indie games or TTRPG projects than a large AAA project!
